Withum Explains Why PPP Loan Forgiveness May Not Be Tax-Free

1/10/22 Update: OSHA’s ETS on COVID-19

Today is the first day the Occupational Safety & Health Administration (OSHA) can begin enforcement of the planning and record keeping mandates in its Emergency Temporary Standard (ETS) on vaccine mandates. While the Supreme Court of the United States (SCOTUS) heard oral arguments of the appeal on January 7, 2022, it has not reached a determination. ETS NEWS 12/17/21 – 6th Circuit Dissolved the Stay of the OSHA ETS, Emergency Stay Application Filed, New Compliance Deadlines

A three-judge panel of the 6th Circuit Court of Appeals dissolved the stay of the Occupational Safety & Health Administration (OSHA) Emergency Temporary Standard (ETS) on vaccine mandates and testing on December 17, 2021. An emergency stay application has since been filed with the Supreme Court of the United States (SCOTUS) and OSHA has announced new compliance deadlines for implementation and enforcement of the ETS.

OMB and SFW Issue Updated COVID-19 Workplace Safety Guidance for Federal Contractors and Subcontractors

The Safer Federal Workforce (SFW) Task Force issued updated Frequently Asked Questions based on Office of Management and Budget (OMB) guidance on non-enforcement of vaccination on Federal contracts and subcontracts. The guidance, which applies to those that had been governed by the vaccination mandates in EO 14042, comes after recent court decisions stayed the effectiveness of those rules pending further legal challenges.

Nationwide Hold on Federal Contractor COVID-19 Executive Order

The U.S. District Court for the Southern District of Georgia has issued a nationwide injunction blocking the federal contractor vaccine mandate. This injunction prevents the U.S. government from enforcing a COVID-19 vaccine mandate on federal contractors, temporarily shutting down the vaccine requirement by the current administration. It is likely that the government will appeal. MCAA will keep you informed as we are in the process of putting together further communications. A copy of the order is attached.

THE EXECUTIVE ORDER IMPACT ON COVID SAFETY PROTOCOLS FOR FEDERAL CONTRACTORS

On September 9, 2021, President Biden issued an Executive Order on ensuring adequate COVID safety protocols for federal contractors. In short, the order is extensive and requires all contractors working on federally funded projects over $250,000 to comply with all guidelines provided by the Safer Federal Workforce Task Force (SFWTF).

While the standard has been temporarily stayed by the Fifth Circuit, MCAA wants to help mechanical construction, service, and fabrication shop employers prepare in the unlikely event the stay is temporarily lifted and OSHA decides to initiative enforcement. 5th Circuit Court Issues New Order Continuing Stay

On Friday, November 12, 2021, the United States Court of Appeals for the Fifth Circuit continued its stay on the implementation of the OSHA Emergency Temporary Standard (ETS) on vaccine mandates and testing pending a full review of the request for a permanent injunction. It also directed OSHA to “take no steps to implement or enforce the mandate until further court order.” MCAA will continue to provide updates as the situation evolves.

OSHA ETS on COVID-19 Stayed, Delaying Enforcement

On November 6, 2021, the attorneys general in ten states (Alaska, Arizona, Arkansas, Montana, Nebraska, New Hampshire, North Dakota, South Dakota, Wyoming, Iowa) sued the Biden administration over the Occupational Safety & Health Administration (OSHA) Emergency Temporary Standard (ETS) on COVID-19 that would have been effective immediately. As anticipated, the ETS has been stayed by the 5th Circuit Court of Appeals. MCAA members won’t have to worry about enforcement until the courts hear, and rule on, the lawsuits.

SFW Task Force Provides Additional COVID-19 Workplace Safety Guidance for Federal Contractors and Subcontractors

The Safer Federal Workforce (SFW) Task Force issued more detailed compliance guidance for direct Federal prime contractors and subcontractors performing on direct Federal contracts subject to the COVID-19 employee vaccination mandates under the Biden Administration’s Executive Order 14042. OSHA Issues Highly Anticipated COVID-19 ETS

The Occupational Safety & Health Administration (OSHA) is issuing an Emergency Temporary Standard (ETS) on COVID-19. This ETS is effective immediately, although all aspects of the standard, other than testing, are enforceable starting December 5, 2021. Testing requirements become enforceable starting January 4, 2022.

White House Lifts COVID-19 Travel Bans for Fully Vaccinated Travelers

On October 25, 2021, the White House revoked the prior COVID-19 travel restrictions and announced that as of November 8, 2021, international travelers traveling to the U.S. by air will be permitted to enter the U.S. if they are fully vaccinated, can present evidence of a negative COVID-19 test taken within three days of their entry into the United States, and agree to comply with public health precautions established by the Centers for Disease Control and Prevention (CDC).

U.S. to Lift COVID-19 Travel Ban to Allow Fully Vaccinated Travelers

On October 15, 2021, the White House announced that as of November 8, 2021, the COVID-19 travel restrictions for international travelers coming into the United States will be lifted for those who are fully vaccinated or can present evidence of a negative COVID-19 test taken within three days of their entry into the United States.

The Biden Administration’s Executive Order Ensuring Adequate COVID Safety Protocols for Federal Contractors, Executive Order 14042 issued September 9, 2021, applies to direct Federal prime contracts above $250,000 and all lower tier subcontracts for work performed at the project site and facilities where work is performed pertaining to covered prime contracts and subcontracts. It does not apply to Federally assisted contracts or suppliers on covered prime contracts. The EO pertains to both prime and subcontractors, irrespective of total employment, while the other Biden Administration EO on vaccination applies to all employers (Federal contractors or subcontractors or otherwise) who employ 100 or more workers. OSHA COVID-19 ETS & New Guidance for Employers Not Covered by the Standard

OSHA recently released an Emergency Temporary Standard (ETS) on COVID-19 covering settings where employees provide healthcare services or healthcare support services. Contractors providing healthcare support services, such as equipment and facility maintenance, may have to comply with several provisions in the ETS. However, the standard does not apply to “well-defined hospital ambulatory care settings” where all employees are fully vaccinated, all non-employees are screened prior to entry, and people with suspected or confirmed COVID-19 are not permitted to enter those settings. Contractors whose employees are not providing healthcare support services are exempt from the ETS. However, OSHA has updated its guidelines for employers based on the most current guidance from the CDC. Employers are urged to comply with the updated guidelines.

OSHA Releases ETS on COVID-19 and Healthcare Facility Ventilation Requirements

OSHA’s recently presented Emergency Temporary Standard on COVID-19 (ETS) describes specific requirements for healthcare facility ventilation systems. OSHA Suspends Recordkeeping Enforcement of Adverse Reactions to Employer Mandated COVID-19 Vaccinations

DOL, OSHA, and other federal agencies, are working diligently to encourage COVID-19 vaccinations. OSHA does not wish to discourage workers from receiving the COVID-19 vaccination, or disincentivize employers’ vaccination efforts. As a result, OSHA will not enforce 29 CFR 1904’s recording requirements to require any employers to record worker side effects from COVID-19 vaccination through May 2022. The agency will reevaluate the agency’s position at that time to determine the best course of action moving forward.

Are Vaccinated Workers Exempt From COVID-19 Infection Control Measures?

OSHA is reviewing recent CDC guidance and will update their website accordingly. However, until those updates are completed, the agency is referring affected employers to the “CDC guidance for information on measures appropriate to protect fully vaccinated workers.” The highlights of the guidance published by the CDC follow.

Mask Mandates Are Falling – What Are Employers To Do?

On May 13, 2021 the CDC unexpectedly recommended that, with limited exceptions, fully vaccinated individuals can resume all indoor and outdoor activities without wearing masks or social distancing, except where required by law or workplace guidance. Loosening of CDC’s Face Covering Recommendations Do Not Alter Employer Compliance Obligations

The CDC recently changed its recommendations regarding the use of face coverings for fully vaccinated individuals. Under the new guidance, fully vaccinated individuals, in most cases, no longer need to wear face coverings indoors or out, or practice social distancing. However, the loosening of the agency’s COVID-19 face covering recommendations do not change affected employers’ OSHA compliance obligations. Masks and distancing are still mandatory “where required by federal, state, local, tribal, or territorial laws, rules, and regulations, including local business and workplace guidance.”

What to Consider Before Requiring Workers to Get COVID-19 Vaccinations

In most states employers may legally require their workers to get COVID-19 vaccinations, provided that they make reasonable accommodations for medical or religious objections. However, doing so could result in negative consequences, so there are several items your company should consider before deciding whether to require their workers to get vaccinated.

Adverse Reactions to Employer Mandated COVID-19 Vaccines Are OSHA Recordable Cases

CDC Alters Guidelines on Facility Cleaning & Disinfection for COVID-19

The CDC has revised its guidelines regarding cleaning and disinfecting surfaces to prevent the spread of COVID-19. The virus that causes COVID-19 can land on surfaces, and it’s possible for people to become infected if they touch those surfaces and then touch their nose, mouth, or eyes. However, it has been determined that the risk of infection from touching a surface is low. The CDC now believes that the most reliable way to prevent infection is to regularly wash hands and use hand sanitizers.

H.R. 133 Offers Relief, Opportunities and Challenges Going into 2021

The $2.3 trillion Consolidated Appropriations Act, 2021 (H.R. 133) provides badly needed COVID economic relief, construction market stimulus and a forward-looking prospect for market recovery in public sector infrastructure investments as the pandemic recedes. In a memo to the MCAA Government Affairs Committee, Chair Jim Gaffney provided a summary digest of the items most likely to impact MCAA members and the MCAA policy agenda. The President is seeking greater individual stimulus checks, so there may be an amendment or veto, but this summary will stand for most of what will be the final result. Correction: The latest COVID relief measure signed into law Sunday does not extend the requirement that employers offer paid sick and family leave as required under the Families First Coronavirus Relief Act passed last March as erroneously reported in the MCAA summary published in the Weekly Update on December 28, 2020. The latest COVID bill extends only the availability of the refundable tax credit as under the FFCRA until the end of March 2021 for those employers voluntarily providing such paid leave after December 31, 2020. OSHA Provides New COVID-19 Guidance Regarding Workplace Ventilation

OSHA recently issued new guidance on how to use workplace ventilation systems to reduce exposures to the coronavirus, including efficiency targets for air filters and recommendations for fan use. The guidance calls for employers to install HVAC filters with minimum efficiency reporting value ratings of “13 or higher, where feasible,” and to “consider using” high-efficiency particulate air fan and filtration systems, “especially in higher-risk areas.”

New Research Shows that Airborne Transmission of COVID-19 Can Occur When Conditions are Right

The CDC recently reported that airborne transmission of SARS-CoV-2 can occur in rare cases under just the right circumstances. In most cases, the virus is transmitted from one person to another in droplet form, and occurs when affected individuals are less than six feet away from the source for 15 minutes or more. OSHA recently revised its plan for enforcing safe workplace requirements concerning COVID-19. The memorandum the agency sent to its regional administrators provides instructions and guidance for handling COVID-19-related complaints, referrals, and severe illness reports. The previous COVID-19 enforcement guidance document sent to the regional administrators back in April has been rescinded.

Specific Foreign Made N95 Type Respirator Use is Permissible for COVID-19 Protection

The Occupational Safety and Health Administration’s (OSHA) respiratory protection standard requires respirators used by workers to be certified by OSHA’s research arm, the National Institute for Occupational Safety and Health (NIOSH). However, that requirement has been suspended temporarily due to a shortage of NIOSH-certified N95 respirators in the United States. OSHA, in agreement with the Food and Drug Administration (FDA), recently released guidance to their regional administrators outlining enforcement discretion to permit the use of filtering facepiece respirators (FFR) certified under certain standards of other countries or jurisdictions.

OSHA Addresses COVID-19 Recordability Issue

The Occupational Safety and Health Administration (OSHA) released enforcement guidance for recording cases of COVID-19. Until further notice, OSHA will not enforce its record-keeping requirements to require employers to make work-relatedness determinations for COVID-19 cases, except where: (1) There is objective evidence that a COVID-19 case may be work-related; and (2) The evidence was reasonably available to the employer.

OSHA & CDC/NIOSH Release Guidance on N95 Respirator Extended Use and Reuse

The Occupational Safety and Health Administration (OSHA) recently released guidelines to help combat supply shortages of disposable N95 filtering face piece respirators. The agency’s guidelines address alternatives to N95s, and extended use and reuse of the respirators. The Centers for Disease Control and Prevention (CDC) and the National Institute for Occupational Safety and Health (NIOSH), which is the research arm of OSHA, also released N95 guidelines addressing extended use and reuse of the respirators, specifically for healthcare settings.

20-Question Multiple Choice Trainee Test Corresponding with MCAA Safety Talk: COVID-19

MCAA developed a best practices guidance document to help protect mechanical construction and service workers from COVID-19 exposure. MCAA and the United Association partnered with several industry experts to gather all facts and proper procedures concerning this virus. Because MCAA members are using the safety talk for worker training, MCAA developed a 20-question multiple choice test and accompanying answer key to help members document that the training occurred, and that trainees understand the training content.

FFCRA Employer Paid Leave Requirements Digest

The Families First Coronavirus Response Act (FFCRA) requires certain employers to provide their employees with paid sick leave or expanded family and medical leave for specified reasons related to COVID-19. The Department of Labor’s Wage and Hour Division administers and enforces the new law’s paid leave requirements. These provisions are effective on April 1, 2020, and apply to leave taken through December 31, 2020.

Cohen Seglias Releases COVID-19 Resource Package 2.0

Cohen Seglias’ Construction Contracts & Risk Management Group prepared sample notice letters for use on jobs where contractors and subcontractors are still ordered to work either in violation of shutdown orders or under unsafe work conditions that are contrary to the CDC guidelines. Also, with many companies still bidding and entering into contracts for new work, Cohen Seglias is providing sample force majeure language that covers pandemics such as this as an unforeseen event entitling you to an extension of time and an increase in price caused by any resultant delays.

DOL Releases Field Assistance Bulletin 2020-1 & FFCRA Posters for Employers

The DOL Wage and Hour Division has updated their COVID-19 webpage to include Field Assistance Bulletin 2020-1, announcing a temporary non-enforcement period. Joint Letter Regarding HVAC Techs as Essential Employees

Earlier this week a joint coalition of HVAC associations sent a letter to local, state and federal officials urging them to consider HVACR technicians and engineers as essential businesses and not restrict their travel. These employees are essential to maintain HVAC and commercial refrigeration equipment. Aside from providing comfort, this equipment is vital for health and safety in addition to productivity, particularly for air filtration and food and medical supply preservation, especially in this time of quarantine. When equipment fails, technicians must be able to repair or replace it as quickly as possible.
